By accessing or using Aurum Health ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

We may modify these Terms at any time. Continued use after modifications constitutes acceptance of the updated Terms.

2. Description of Service

Aurum Health is a personal health intelligence platform that:

  • Aggregates health data from wearables and manual entries
  • Calculates a comprehensive "Aurum Score" for daily wellness
  • Provides AI-powered health coaching and insights
  • Displays trends and analytics for health optimization

3. Medical Disclaimer

IMPORTANT:

Aurum Health is NOT a medical device and does NOT provide medical advice, diagnosis, or treatment. The Service is for informational and wellness purposes only. Always consult a qualified healthcare provider for medical concerns. Do not disregard professional medical advice or delay seeking treatment based on information from this Service.

The AI Health Coach is powered by artificial intelligence and may provide general wellness information. It is not a substitute for professional medical advice.

4. User Accounts

4.1 Account Creation

You must be at least 13 years old (or 16 in the EEA) to create an account. You agree to provide accurate information and keep your credentials secure.

4.2 Account Responsibility

You are responsible for all activity under your account. Notify us immediately of any unauthorized access.

4.3 Account Termination

We reserve the right to suspend or terminate accounts that violate these Terms or engage in harmful behavior.

5. Subscription and Billing

5.1 Free and Premium Tiers

Aurum Health offers a Free tier with limited features and Premium/Family tiers with additional functionality. Pricing is displayed in the app and on our website.

5.2 Billing

Premium subscriptions are billed monthly or annually. Payment is processed through Apple App Store or Google Play Store. Subscriptions auto-renew unless cancelled.

5.3 Cancellation

You may cancel your subscription at any time through the respective app store. Access continues until the end of the billing period.

5.4 Refunds

Refund requests are handled by Apple or Google according to their policies. We do not process refunds directly.

6. Acceptable Use

You agree NOT to:

  • Use the Service for any illegal purpose
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service
  • Reverse engineer or decompile the app
  • Use automated tools to access the Service
  • Impersonate others or provide false information
  • Share your account credentials with others

7. Intellectual Property

The Service, including all content, features, and functionality, is owned by Aurum Health and protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

You retain ownership of your personal data. By using the Service, you grant us a license to process your data to provide the Service.

8. Third-Party Services

The Service integrates with third-party platforms (Apple HealthKit, Google Health Connect, Oura, Whoop, etc.). Your use of these integrations is subject to their respective terms and privacy policies. We are not responsible for third-party services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that the Service will be uninterrupted, secure, or error-free. We do not guarantee the accuracy or completeness of health insights provided.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AURUM HEALTH SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR HEALTH OUTCOMES.

Our total liability shall not exceed the amount you paid for the Service in the preceding 12 months.

11. Indemnification

You agree to indemnify and hold harmless Aurum Health and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.

12. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.

13. Dispute Resolution

Before initiating legal action, you agree to attempt to resolve disputes informally by contacting us at [email protected].

You agree to resolve disputes through binding arbitration (AAA Commercial Arbitration Rules) rather than court, except for claims in small claims court.

14. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full force and effect.
